
John Roszkowski of McKnights Long-Term Care News reports that silent immigration raids on senior care operations are likely in 2025. In his interview with Attorney Robert Divine of Baker Donelson, Divine commented that it seems improbable federal agents would conduct armed immigration raids at nursing homes to arrest undocumented workers and seize employment records. However, Divine warns of what he called "silent raids." Silent raids are when immigration officials conduct audits of I-9 records to determine if facilities employ any undocumented workers. "That audit has the effect of taking people out of the workforce," states Divine. "It's just a less forceful way of doing it."
Foley & Lardner LLP reports that the US Department of Homeland Security (DHS) increased the penalties for I-9 violations. The current I-9 violation penalties are:
I-9 Paperwork Violations - $2,789 per Form I-9
Knowingly Employing Unauthorized Alien (First Offense) - $5,579 per violation
Knowingly Employing Unauthorized Alien (Second Offense ) - $13,946 per violation
Knowingly Employing Unauthorized Alien (Third or More Offense ) - $27,894 per violation
E-Verify Employers - Failure to Inform DHS of Continuing Employment Following Final Non-conformations - $1,942 per relevant individual employee
